BY ACCESSING, USING, MAKING TRANSACTIONS, ENROLLING IN COURSES, OR INTERACTING WITH OUR SERVICES, YOU AGREE TO THESE TERMS IN FULL. IF YOU DISAGREE WITH ANY PART OF THESE TERMS, YOU MAY NOT USE THE SERVICES. USERS WHO REGISTER ACCOUNTS OR PAY FOR SERVICES (“SUBSCRIBERS”) AGREE TO BE BOUND BY THESE TERMS.

Your use of https://www.innovatrade.ai/, its subdomains, affiliated websites, and mobile applications (collectively referred to as the “Site”), which are owned and operated by Innova Trade AI, LLC (“Innova Trade,” “we,” “our,” or “us”), is governed by the policies, terms, and conditions detailed here. By accessing, using, or making a purchase through the Site, you agree to abide by these Terms. If you do not accept these Terms in full, you are not permitted to access or use the Site in any capacity.

2 You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

MANDATORY ARBITRATION AND CLASS ACTION WAIVER
This Agreement includes provisions for mandatory arbitration and a waiver of your rights to a court hearing, jury trial, or participation in a class action. Arbitration is the required and sole method for resolving all disputes, except as specified in Section 17 or if you opt out. Please carefully review the Dispute Resolution section (Section 17) for details about your opt-out rights.

CHANGES TO THE TERMS
The most current version of these Terms is always available on this page (Terms and Conditions | Innova Trade). We reserve the right to update, modify, or replace any part of these Terms by posting changes on the Site. It is your responsibility to regularly check this page for updates.

Your continued use of the Site after any changes are posted signifies your agreement to the updated Terms. If you do not agree with any modifications, you must stop using the Site immediately.

1. Use Of Site

The Innova Trade Site, along with its products and services, is designed for use by adults only. By accessing the Site and agreeing to these Terms, you confirm that you have reached the age of majority as defined by the laws of your state or province of residence. Additionally, by using the Site, you affirm that you possess the legal capacity to enter into a binding agreement with us, have reviewed this Agreement, and fully understand and accept its terms.

2. Modifications To The Terms

Innova Trade retains the right to modify, update, or replace any portion of these Terms by posting the revised version on our Site. The latest version of the Terms is always available for review on this page (Terms and Conditions | Innova Trade AI). It is your responsibility to periodically check this page for updates. Your continued access to or use of the Site after any changes have been posted signifies your acceptance of the updated Terms.

3. Privacy And Security Disclosure

The Privacy Policy of Innova Trade AI is available for review at Privacy Policy | Innova Trade AI. This Privacy Policy is incorporated by reference into these Terms and is an integral part of this Agreement. Innova Trade reserves the right to amend the Privacy Policy at its sole discretion.

4. No Investment Recommendations Or Professional Advice

Innova Trade does not offer personalized investment, tax, legal, or insurance advice. The Site and all associated products or services are not designed to provide specific recommendations or advice in these areas. Nothing on the Site or within Innova Trade’s offerings should be interpreted as an offer to sell, a solicitation to purchase, or an endorsement of any security or financial strategy by us or any third party.

You are solely responsible for determining whether any investment, security, strategy, or service aligns with your personal objectives and financial circumstances. It is strongly recommended that you consult a licensed investment advisor, attorney, or tax professional for guidance tailored to your specific financial, legal, or tax situation.

5. No Direct Lending
Innova Trade is a provider of tradding education and training services. We do not engage in lending activities, whether for personal or business purposes. Decisions regarding loan approvals, amounts, interest rates, and other terms are determined solely by third-party lenders and are beyond our control. Innova Trade makes no guarantees regarding your eligibility for or approval of any specific loan offer from any lender.

6. Securities & Investing Disclosure

Trading stocks and options offers the potential for significant rewards but also comes with considerable risks. It is important to understand these risks fully and only invest money you can afford to lose. Innova Trade does not guarantee that any account will achieve results similar to those discussed on the Site, whether profits or losses. Past performance of any trading strategy, system, or methodology should not be considered an indicator of future results.

The trades, patterns, charts, systems, and methodologies shared on the Site are provided solely for illustrative purposes and are not intended as specific investment advice or recommendations. All information on the Site is for educational and informational purposes only.

7. Intellectual Property

The Site and all content available within it—including, but not limited to, text, documents, articles, products, software, graphics, photos, sounds, videos, interactive features, services, links, user submissions, third-party applications, and any other materials (“Content”)—as well as trademarks, service marks, and logos, are the exclusive property of Innova Trade and its third-party licensors or providers. You may access and use the Content, as well as download or print copies of any material from the Site, strictly for your personal, non-commercial use. When downloading or printing Content, you must retain all copyright and proprietary notices.

By using the Site, you acknowledge that you do not gain any ownership rights to the Content or the Site itself. Innova Trade retains all rights not expressly granted under these Terms.

You further agree not to bypass, disable, or otherwise interfere with security features of the Site or mechanisms designed to prevent unauthorized use or copying of the Content or to enforce limitations on its use.

8. Prohibited Use

In addition to the restrictions outlined in these Terms, the following activities are strictly prohibited when using the Site or its Content:
(a) Engaging in unlawful activities;
(b) Soliciting others to participate in illegal acts;
(c) Violating any international, federal, provincial, or state regulations, laws, or ordinances;
(d) Infringing upon Innova Trade’s intellectual property rights or those of others;
(e) Harassing, abusing, insulting, harming, defaming, slandering, intimidating, or discriminating against others based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
(f) Providing false or misleading information;
(g) Uploading or transmitting viruses or malicious code that could harm the functionality of the Service, the Site, or related websites;
(h) Collecting or tracking the personal data of others without authorization;
(i) Spamming, phishing, pharming, pretexting, spidering, crawling, or scraping;
(j) Using the Site for obscene or immoral purposes; or
(k) Interfering with or circumventing the security features of the Service, the Site, or related websites.

Innova Trade reserves the right to terminate your access to the Site or any related service if you violate any of the above prohibitions.

9. Termination

The obligations and responsibilities of both parties that were established prior to the termination date will remain in effect even after this agreement is terminated.

These Terms will continue to apply unless and until they are terminated by either you or us. You may terminate this agreement at any time by notifying us that you no longer wish to use our Services or by discontinuing your use of the Site.

If, in our sole discretion, we determine that you have violated any provision of these Terms or if we suspect such a violation, we reserve the right to terminate this agreement at any time without prior notice. In such a case, you will still be responsible for any outstanding amounts owed up to and including the termination date, and we may also deny you access to our Services (or any part thereof).

10. Prohibited Conduct

By using the Site, you agree not to engage in any of the following prohibited activities:

Copying, distributing, or disclosing any portion of the Site through any medium, including automated or manual methods such as “scraping.”
Using automated systems like “robots,” “spiders,” or “offline readers” to access the Site in a manner that generates more requests to the Innova Trade servers than a human could reasonably produce with a standard web browser (exceptions apply to public search engine operators who have revocable permission to copy materials solely for publicly available searchable indices, excluding caches or archives).
Sending spam, chain letters, or other unsolicited communications.
Attempting to compromise the Site’s system integrity or security or deciphering transmissions to or from the servers hosting the Site.
Taking actions that impose, at our discretion, an unreasonable or disproportionately large load on our infrastructure.
Uploading invalid data, viruses, worms, or other harmful software through the Site.
Collecting or harvesting personally identifiable information, such as account names, from the Site.
Using the Site for any unauthorized commercial solicitation.
Impersonating another person, misrepresenting your affiliation with a person or entity, engaging in fraud, or attempting to conceal your identity.
Interfering with the proper functionality of the Site.
Accessing content on the Site through unauthorized technologies or methods.
Bypassing any measures implemented to prevent or restrict access to the Site, including features designed to limit the use or copying of Site content.

Violation of any of these rules may result in the suspension or termination of your access to the Site and/or legal action, depending on the severity of the infraction.

11. User Accounts

To access certain Services or features on the Site, you may need to create an account and set a password. To do so, you must be at least 18 years old and provide accurate and truthful information about yourself. Impersonating another person or providing false information when creating an account is prohibited. If your details change, it’s your responsibility to update your account information promptly.

In some instances, an account may be created for you by an administrator, such as your employer or an educational institution. If this applies to you, additional terms may govern your use of the Site, and your administrator may have the ability to access, manage, or disable your account independently.

Account sharing is not allowed. You are responsible for keeping your password confidential and should avoid using the same password across multiple websites. If you suspect your account has been compromised, notify your system administrator immediately.

To request the deletion of your account, contact us at [info@innova-trade.com]. We will begin the process of deleting your account; however, we may retain certain account information as required by law or for legitimate business purposes. After account deletion, your profile will no longer be visible to other users, but any public comments you’ve made on the Site will remain. Please note that deleting your account will restrict your access to features that require account registration.

12. Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. By using the Site, you agree to:
(a) Notify Innova Trade immediately if you become aware of any unauthorized access to your account or any other security breach, and
(b) Log out of your account at the end of each session.

Innova Trade is not liable for any loss or damage resulting from your failure to fulfill these responsibilities.

13. Modifications to the Service and Prices

The prices of our products are subject to change at any time without prior notice.

We reserve the right to modify, suspend, or discontinue the Service (or any part or content within it) at any time without notice.

Innova Trade is not responsible or liable to you or any third party for any changes to prices, modifications, suspensions, or discontinuations of the Service.

14. Products or Services

Certain products or services are available exclusively online through the website. These items may have limited availability and are subject to return or exchange only in accordance with our Return Policy.

While we strive to display product colors and images as accurately as possible, we cannot guarantee that the color display on your computer monitor will be entirely accurate.

We reserve the right, at our sole discretion, to restrict the sale of our products or services to any individual, geographic area, or jurisdiction. This right may be exercised on a case-by-case basis. Additionally, we reserve the right to limit the quantity of products or services offered.

All product descriptions and pricing are subject to change at any time without prior notice, at our sole discretion. We also reserve the right to discontinue any product or service at any time. Any offer for a product or service on this site is void where prohibited by law.

15. Governing Law and Arbitration

This Agreement is governed by and interpreted under the laws of the State of Nevada, without regard to conflict-of-law principles. The Client agrees that Nevada law will apply to any matter or dispute arising out of or relating to this Agreement, as well as any other disputes between the Client and Innova Trade. The Parties acknowledge that this choice of law, venue, and jurisdiction is mandatory and not permissive. The Client waives any objections to the venue, including claims based on the doctrine of forum non-conveniens or similar doctrines.

The arbitrator will follow the substantive law of the State of Nevada, regardless of its conflict-of-law principles. Any arbitration award issued shall include a confidential written opinion and will be binding, subject to appeal under the Federal Arbitration Act (FAA). The judgment on the arbitrator’s award may be enforced in any court with proper jurisdiction.

Enforceability

This provision remains valid beyond the termination of your account or relationship with Innova Trade, including in cases of bankruptcy, assignment, or transfer. If the class action waiver is found unenforceable, allowing arbitration to proceed as a class or representative action, the entire arbitration provision will become null and void. However, if any other portion of this arbitration provision (excluding the class action waiver) is deemed unenforceable, the remaining sections of the arbitration provision will remain fully effective.

16. Miscellaneous

The failure or delay in enforcing this arbitration provision for any specific claim does not waive the right to enforce arbitration later for that claim or any other claims. All claims must still be brought within the one-year limitation period outlined above. This provision represents the complete arbitration agreement between you and Innova Trade and can only be modified in writing by Innova Trade.

Amendments

Innova Trade reserves the right to amend this arbitration provision at any time. Your continued use of the Site, purchase of a product or service through the Site, or use or attempted use of any Innova Trade product or service signifies your acceptance of these changes. If substantial amendments are made to this arbitration provision, Innova Trade will provide notice and an opportunity to opt out. Continuing to use the Site, make purchases, or use Innova Trade products or services after such changes constitutes your consent to these amendments.

YOU ACKNOWLEDGE AND AGREE THAT ANY CLAIMS WILL BE RESOLVED INDIVIDUALLY AND EXCLUSIVELY THROUGH BINDING, FINAL, AND CONFIDENTIAL ARBITRATION. YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION PROVISION WITHIN FOURTY_FIVE (45) DAYS OF THE DATE YOU FIRST PURCHASE, USE, OR ATTEMPT TO USE A PRODUCT OR SERVICE THROUGH THE SITE (WHICHEVER OCCURS FIRST). TO OPT OUT, YOU MUST SEND A SIGNED WRITTEN NOTICE TO INFO@INNOVATRADE.AI. YOUR NOTICE MUST INCLUDE:

A CLEAR IDENTIFICATION OF THE PRODUCT OR SERVICE YOU PURCHASED, USED, OR ATTEMPTED TO USE; AND
THE DATE YOU FIRST PURCHASED, USED, OR ATTEMPTED TO USE THE PRODUCT OR SERVICE.

IF MORE THAN FOURTY FIVE (45) DAYS HAVE PASSED SINCE THAT DATE, YOU WILL NO LONGER BE ELIGIBLE TO OPT OUT AND MUST RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION AS OUTLINED IN THIS AGREEMENT.

17. Indemnification

To the fullest extent allowed by law, you agree to indemnify, defend, and hold harmless Innova Trade, its affiliates (including any affiliated professional entities), subsidiaries, and their directors, officers, employees, contractors, licensors, suppliers, representatives, proprietors, partners, shareholders, agents, predecessors, successors, assigns, accountants, and attorneys from and against any claims, actions, losses, liabilities, damages, expenses, demands, and costs, including reasonable attorneys’ fees. This obligation applies to any claims arising out of or related to:

Your breach of these Terms, any referenced documents, or the Agreement;
Your breach of any representations or warranties outlined in this Agreement; or
Your violation of any laws or the rights of third parties.

18. Third-Party Websites and Links

The Site may contain materials from third parties or links to external websites. Innova Trade is not responsible for the content, policies, or practices of any third-party materials or websites. Before engaging in any transactions or interactions, please carefully review the policies and terms of the third-party. Any complaints, claims, concerns, or questions about third-party products or services should be directed to the respective third party.

19. Testimonials, Reviews, and Other Submissions

Innova Trade values feedback from its users and customers and encourages comments about its services and products. By submitting a testimonial or product review, you confirm that the information you provide is accurate, truthful, and does not violate the intellectual property rights of any third party. Innova Trade reserves the right to use testimonials or reviews, in whole or in part, including the name and location of the person submitting them, for promotional purposes related to its products or services. Testimonials reflect the unique experiences of individual customers and may not represent the typical results or experiences others may have.

Any content submitted to the Site or directly to Innova Trade, including testimonials, reviews, photographs, ideas, know-how, techniques, questions, comments, or suggestions (collectively, "Submissions"), is considered non-confidential and non-proprietary. Innova Trade reserves the right to use, reproduce, distribute, publish, perform, display, sell, lease, or create derivative works from these Submissions in any form or medium. By submitting content, you represent and warrant that you own or have the legal right to share the Submissions with Innova Trade. All Submissions become the exclusive property of Innova Trade and will not be returned.

Innova Trade also reserves the right to correct grammatical errors, shorten testimonials, and review all content before publication or use. However, Innova Trade is not obligated to use any testimonial, review, or submission in part or in full. By submitting content, you confirm that you have read and agree to these Terms. If you disagree with any part of these Terms, please refrain from submitting a testimonial or review.

20. Electronic Communications

By using our Services, you consent to receive communications from us electronically. These communications, including notices, disclosures, agreements, and other correspondence, are equivalent to written communications and carry the same legal weight as if they were provided in writing and signed by the sender.

21. Assignment

You are not permitted to assign any of your rights or obligations under these Terms. Any attempt to do so will be considered null and void. Innova Trade and its affiliates, however, may transfer their rights and obligations under these Terms without your consent or notification in the event of a merger, sale of assets, or other business transaction involving Innova Trade.

22. No Waiver

No action or inaction by Innova Trade regarding any term or condition of these Terms shall be interpreted as a waiver of that term or condition. Additionally, a failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision. All terms and conditions remain enforceable unless explicitly waived in writing.

23. No Agency Relationship

Nothing in these Terms creates a joint venture, partnership, employment, or agency relationship between you and Innova Trade. Your use of the Site and Services does not establish any such relationship.

24. Prohibited Conduct

You agree not to attempt to reverse engineer, disassemble, or decompile any code or software associated with the algorithm or the website. Additionally, you must not attempt to access the algorithm or the website by bypassing security protocols or utilizing tools designed to circumvent authorization measures.

25. Liability Disclaimer

Innova Trade is not responsible for the security of your account, network, or the operations of the algorithm. By using the website, you acknowledge and agree that such use is entirely at your own risk.
